David heads Crowe Clark Whitehill's Tax Investigation Group, specialising in PAYE investigations and cases involving serious fraud. He is a member of the Tax Investigations Practitioners Group. More

Partner 

Specialises in all aspects of tax investigations and compliance matters. He regularly negotiates settlements with HM Revenue & Customs (HMRC) and deals with cases involving serious fraud and potential prosecution. More 

 

Arthur Blackburn

Prior to joining Crowe Clark Whitehill, Arthur was a senior officer with HM Customs and Excise for eight years where his duties included visiting businesses and training other officers in VAT. More

Martin is a former Senior Principal Inspector of Taxes with over 30 years’ experience in tax investigation work. He spent 17 years with the Inland Revenue (now HMRC) in the Special Compliance Office (now Specialist Investigations), initially as a senior investigator and then the officer in charge of Manchester Special Compliance Office. More

Survey finds lack of publicity is hindering LDF and UK/Swiss Taxation Agreement  

LDF Survey image 2012Crowe Clark Whitehill’s Tax Investigations Group has carried out its second online survey of accountants to measure awareness
and perceptions of the Liechtenstein Disclosure Facility (LDF) and the UK/Swiss Taxation Agreement.

The findings indicate that in general terms there has been a deterioration in accountants’ knowledge of the LDF. This may be at least partly due to the fact that HM Revenue & Customs did not undertake any noticeable marketing or promotion of the LDF during 2011.

Our survey reveals that nearly one in five of those accountants
surveyed does not understand what the LDF is or the principles that underpin it. Additionally one in ten has no knowledge of the benefits that the LDF offers, with 56% only have a limited understanding. Clearly, if accountants do not fully understand the LDF, HMRC cannot expect them to market it to their clients. This is borne out by the fact that 79% of accountants surveyed have so far mentioned the LDF to five or fewer clients.

In contrast, knowledge of the UK/Swiss agreement is higher, with 88% of accountants being aware that an agreement had been signed, probably as a result of the more high profile press coverage received in autumn 2011. Despite this though, nearly half of those surveyed had not yet mentioned the UK/ Swiss agreement to any of their clients.

A key message coming out of the survey is that HMRC should be doing more to publicise both the LDF and the UK/Swiss agreement. As well as increasing awareness, this would also empower accountants to have dialogue with a far higher proportion of their clients.

Finally the survey finds that there is an unequivocal call for HMRC to launch one final General Disclosure Facility, to encompass all UK taxpayers and not just those with overseas income or those belonging to specific groups. 79% of practitioners said they would mention a GDF to at least 20 clients, with 63% undertaking to make all of their clients aware of it.

The UK government yesterday initialled an Agreement with Switzerland to tax undeclared assets held in Swiss bank accounts which is expected to bring in revenues for the Exchequer of between £5 billion and £6 billion with an upfront goodwill payment of 500 million Swiss francs (approximately £385 million).
